FORGE Defense Logistics Platform

1. Acceptance of Terms

By accessing or using the FORGE platform ("Service"), operated by BigForgeOne LLC ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and the Company.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

FORGE is a defense logistics Software-as-a-Service (SaaS) platform designed for military, government, and authorized defense contractor use. The Service provides capabilities including but not limited to:

  • Inventory management and asset tracking
  • Work order creation and lifecycle management
  • Maintenance, Repair, and Overhaul (MRO) operations
  • Vehicle and equipment inspections
  • Bill of Materials (BOM) and kitting operations
  • Procurement workflows (purchase orders, receiving, vendors)
  • Cycle counting and barcode/QR scan-based lookup
  • Reporting and Common Operating Picture (COP) dashboards

3. User Accounts and Security

Access to the Service requires a valid user account authenticated through Amazon Cognito. You are responsible for maintaining the confidentiality of your credentials and for all activities conducted under your account.

  • The platform employs Role-Based Access Control (RBAC) to restrict functionality based on your assigned role and organizational group.
  • Multi-tenant architecture ensures that data belonging to one organization is logically isolated from other organizations.
  • You must immediately notify us of any unauthorized use of your account or any other security breach.

4. Acceptable Use

The Service is intended exclusively for authorized defense, government, and defense-contractor logistics operations. You agree that you will not:

  • Access the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any portion of the Service, other accounts, or connected systems
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Introduce malware, viruses, or other harmful code
  • Use the Service in any manner that could damage, disable, or impair the platform
  • Share credentials or allow unauthorized individuals to access the Service
  • Export any data from the Service in violation of applicable export control regulations

5. Data Handling and Storage

Your data is stored in Amazon DynamoDB with encryption at rest provided by AWS Key Management Service (KMS). All data transmissions are encrypted in transit via TLS 1.2 or higher. File attachments and documents are stored in Amazon S3 with server-side encryption enabled.

The platform is architected to support migration to AWS GovCloud (US) regions for customers requiring FedRAMP-compliant hosting. All infrastructure is currently deployed in the AWS us-east-1 region.

You retain ownership of all data you submit to the Service. We will not access, use, or disclose your data except as necessary to provide the Service, comply with legal obligations, or as authorized by you.

6. Intellectual Property

All rights, title, and interest in and to the Service, including all software, algorithms, user interfaces, designs, trademarks, and documentation, are and shall remain the exclusive property of BigForgeOne LLC. Nothing in these Terms grants you any right to use our trade names, trademarks, service marks, or logos.

You retain all rights to data and content you upload to the Service. By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service.

7. CUI/ITAR Compliance Notice

NOTICE: The FORGE platform may be used to manage Controlled Unclassified Information (CUI) and data subject to the International Traffic in Arms Regulations (ITAR). Users are responsible for ensuring that their use of the Service complies with all applicable federal regulations, including but not limited to:

  • NIST SP 800-171 (Protecting CUI in Nonfederal Systems)
  • DFARS 252.204-7012 (Safeguarding Covered Defense Information)
  • ITAR (22 CFR Parts 120–130)
  • EAR (15 CFR Parts 730–774)

BigForgeOne LLC is committed to supporting compliance with these requirements and is actively pursuing CMMC Level 2 certification. However, ultimate responsibility for compliance with CUI handling requirements rests with the User and their organization.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIGFORGEONE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon written notice. You may terminate your account at any time by contacting us. Upon termination:

  • Your right to access the Service will immediately cease
  • We will retain your data for a period of thirty (30) days, during which you may request data export
  • After the retention period, your data will be permanently deleted
  • Provisions that by their nature should survive termination shall survive, including Sections 6, 7, 8, and 10

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Hillsborough County, Florida.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BigForgeOne LLC regarding the use of the Service.
